Fleets that don‚Äôt make red-light, speed or school bus stop arm¬≠safe¬≠ty cam¬≠era vio¬≠la¬≠tions part of their dri¬≠vers‚Äô safe¬≠ty pro¬≠file are run¬≠ning the risk of mul¬≠ti-mil¬≠lion dol¬≠lar lia¬≠bil¬≠i¬≠ty costs, says Vin¬≠cent Brigi¬≠di, pres¬≠i¬≠dent and chief oper¬≠at¬≠ing offi¬≠cer of The CEI Group, Inc., a fleet ser¬≠vices provider.
Accord¬≠ing to Amer¬≠i¬≠can Traf¬≠fic Solu¬≠tions (ATS) Fleet Ser¬≠vices, a lead¬≠ing provider of fleet toll and vio¬≠la¬≠tion man¬≠age¬≠ment solu¬≠tions, the num¬≠ber of road safe¬≠ty cam¬≠era vio¬≠la¬≠tions issued to fleet vehi¬≠cles has soared over the last five years.
The prob¬≠lem for fleets is these types of tick¬≠ets are issued to the own¬≠ers of the vehi¬≠cles ‚Äď usu¬≠al¬≠ly the fleet or its leas¬≠ing com¬≠pa¬≠ny ‚Äď and not to the dri¬≠vers and rarely appear on dri¬≠vers‚Äô Motor Vehi¬≠cle Records (MVR), Mr. Brigi¬≠di notes. Since MVRs are one of the prin¬≠ci¬≠ple tools used to iden¬≠ti¬≠fy and inter¬≠vene with high-risk dri¬≠vers, fleets may be unaware of dri¬≠vers who rep¬≠re¬≠sent a lia¬≠bil¬≠i¬≠ty if they‚Äôre found respon¬≠si¬≠ble for a col¬≠li¬≠sion.
‚ÄúCam¬≠era vio¬≠la¬≠tions are still pub¬≠lic record, and acces¬≠si¬≠ble to a plaintiff‚Äôs attor¬≠ney,‚ÄĚ Mr. Brigi¬≠di warns. If a fleet dri¬≠ver has a his¬≠to¬≠ry of mul¬≠ti¬≠ple speed¬≠ing, stop arm or red-light run¬≠ning vio¬≠la¬≠tions by road safe¬≠ty cam¬≠eras ‚Äúand the fleet has nev¬≠er tak¬≠en any steps to reme¬≠di¬≠ate the driver‚Äôs behav¬≠ior, it is exposed to the dan¬≠ger of being found guilty of neg¬≠li¬≠gent entrust¬≠ment‚ÄĚ and there have been many cas¬≠es of mul¬≠ti-mil¬≠lion dol¬≠lar judg¬≠ments and set¬≠tle¬≠ments, he not¬≠ed.
Adam Draizin, pres¬≠i¬≠dent of ATS Fleet Ser¬≠vices, adds that fleets typ¬≠i¬≠cal¬≠ly pay road safe¬≠ty cam¬≠era fines right away to avoid penal¬≠ties and then attempt to iden¬≠ti¬≠fy and col¬≠lect from the dri¬≠ver, but it‚Äôs ‚Äúa time-con¬≠sum¬≠ing process that is often unsuc¬≠cess¬≠ful.‚ÄĚ As a result, high-risk dri¬≠vers remain hid¬≠den from the fleet.
The solu¬≠tion is for fleets to adopt tech¬≠nol¬≠o¬≠gy that match¬≠es traf¬≠fic safe¬≠ty cam¬≠era vio¬≠la¬≠tions to the respon¬≠si¬≠ble dri¬≠vers. CEI and ATS have joint¬≠ly devel¬≠oped a solu¬≠tion, which is cur¬≠rent¬≠ly in beta test¬≠ing. CEI expects to roll out the capa¬≠bil¬≠i¬≠ty, cur¬≠rent¬≠ly in beta test¬≠ing, lat¬≠er this year as an enhance¬≠ment to its Dri¬≠ver¬≠Care Risk Man¬≠ag¬≠er‚ĄĘ appli¬≠ca¬≠tion.
